Abstract:When Rijkswaterstaat expect a budget shortfall she often reduces the size of the initial scope to ensure that the procurement procedure will be successful. In retrospect, however, bidding prices often prove to be lower than Rijkswaterstaat estimated. In such case, it can be concluded that Rijkswaterstaat has reduced the size of the scope more than required. This also means that the budget will not fully utilized at once. The remaining budget can be used to put previously deleted parts of the scope into contract via a secondary procurement procedure or as additional work by means of a contract amendment. Performing two procurement procedures or outsourcing additional work via a contract amendment is inefficient. As an alternative Rijkswaterstaat can tender a variable scope in the case of a calculated budget shortfall. Rijkswaterstaat experienced that by doing this she can put out as much of the initial scope into contract, within the given budget, by performing just one procurement procedure. Rijkswaterstaat already conducted several procurement procedures based on a variable scope but didn’t formalized a uniform procurement method yet. The expectation is that Rijkswaterstaat will use the mentioned procurement strategy more often in the future. Therefore she intended to formalize a standard procurement method for tendering a variable scope. Based on the results of a literature review and the input given by several procurement consultants and tendering advisors the procurement method requested by Rijkswaterstaat is developed. As part of the verification and validation process the developed method is checked against the legal procurement principles and discussed with several procurement experts. The research project has resulted in the procurement method called ‘Budget Driven Tendering’. Applying the developed procurement method means:  The budget minus a reservation for overhead costs, mandatory costs for the contracting authority and a risk reservation will be set as the maximum bid.  Rijkswaterstaat will divide the initial scope into a base-scope and one or more supplementary work packages.  The base-scope should be offered by all tenderers.  Tenderers can offer supplementary work packages in addition to the base-scope following the prioritization order set up by Rijkswaterstaat (note that the maximum bid continues to apply).  Tenders should hand in a plan regarding the quality criteria set up by Rijkswaterstaat.  Offering added value by means of quality and quantity (supplementary work packages) will be awarded with a fictitious reduction on the bidding price.  The contract will be awarded to the tendered with the lowest fictitious bid.  The base-scope and the supplementary work packages offered by the winner will be included in the contract.  The quality plan submitted by the winning tenderer will form part of the contract as well.  The winning tenderer will be awarded the contract for the bidding price he submitted. Rijkswaterstaat is obliged to provide bidders the opportunity to distinguish themselves on the level of quality. In Budget Driven Procurement quantity is introduced as third criterion which results in an extra thread regarding the ability for bidders to distinguish themselves on the level of quality. When applying the developed procurement method the fictitious reductions should preserve the opportunity for bidders to distinguish themselves on the level of quality. When applying Budget Driven Procurement Rijkswaterstaat acts in accordance with the principle regarding transparency equality by using a firm and complete Tendering and Assessment Document. Also the division of the initial scope into a base scope and supplementary work packages isn’t in conflict with the principle regarding the proportionality. The conclusion is that Budget Driven Procurement is a proper procurement method which can serve as a foundation in formalizing the procurement procedure for tendering a variable scope. Therefore the procurement board of Rijkswaterstaat is advised to formalise the developed method by means of an official note. In addition, Rijkswaterstaat is recommended to carry out the proposed formalisation according to the plan-do-check-act method. Also, it is suggested to conduct further research regarding the subdivision of the scope and the way the fictitious reduction values are determined.
