Abstract:This bachelor thesis pursues legal hermeneutic research on the relation of drug policy and consumer protection in the EU. While many countries and states in the world are liberalizing their drug legislation, the EU member states are divided among ideological lines with millions of citizens being exposed to the conditions of the illegal market. To explore alternative drug policy, this thesis is looking for new and promising paths in legal research by answering the research question: “To what extent can the EU protect recreational cannabis consumers through liberalized regulation of cannabis supply?” Therefore, the law and history of Canadian and Dutch drug policy will be explained and examined regarding their consumer implications. The legal and institutional relations between national, international and EU level will be studied to elaborate on the feasibility of the internal market integration of cannabis. Having identified best practice and the theoretical construct of drug policy in the EU, consumer protection rights will be interpreted and applied in analogical fashion to build a concept of consumer protection for recreational cannabis. The consumer-based approach is unique in its attempt to align the policy areas of drug policy and consumer protection on the EU level and identifies a framework of responsible market integration of cannabis.
