Abstract:Competition is an important element in the EU markets. But, in a global context, there are cases of companies that apply practices affecting competition. One of these cases is the impact of the Gulf state airlines on the European air transport market. As an answer to these problems the European Commission has proposed a regulation to tackle these issues. This study has examined to what extent the regulation is effective in enforcement against the practices affecting competition of the Gulf states. It showed that there have been difficulties in the detection process and the response process in the old regulatory frameworks. Due to changes in these processes in the new regulation, it is assumed that it is likely that the regulation is effective in enforcement. Consequently, as the regulation is effective in enforcement, it is assumed, based on rational choice institutionalism, that the behavior of the Gulf state carriers will change. It is assumed that the shirking and cheating behavior will decrease and as a result of that, the transaction costs (monitoring and enforcement costs) for the Member States will decrease as well. As such, due to effective enforcement from the supranational level, national transaction costs will be lowered.
